Terms of Service

1. Acceptance of Terms

By creating an account and using SmartWealthForge ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and SmartWealthForge Inc. Your use of the Platform is also governed by our Privacy Policy and Risk Disclosure, which are incorporated by reference.

2. Eligibility

To use SmartWealthForge, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be a resident of a prohibited jurisdiction (see Section 3)
  • Not be subject to sanctions or on any restricted persons list
  • Provide accurate and complete registration information
  • Successfully complete identity verification (KYC) requirements

3. Prohibited Jurisdictions

SmartWealthForge services are not available to residents or citizens of the following jurisdictions:

  • Countries subject to comprehensive U.S. sanctions (including but not limited to Cuba, Iran, North Korea, Syria, and Crimea)
  • Jurisdictions where our services would violate local laws or regulations

By using the Platform, you represent that you are not located in, under the control of, or a national or resident of any prohibited jurisdiction.

4. Account Registration and Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Providing accurate, current, and complete information during registration
  • Updating your information to maintain its accuracy

We reserve the right to suspend or terminate accounts that provide false, inaccurate, or incomplete information.

5. Identity Verification (KYC)

SmartWealthForge is required by law to verify the identity of our users. You agree to:

  • Provide government-issued identification documents when requested
  • Submit to enhanced due diligence procedures if required
  • Allow us to use third-party services to verify your identity
  • Acknowledge that failure to complete KYC may result in account limitations or closure

6. Trading and Investment Services

SmartWealthForge provides a platform for trading cryptocurrencies, stocks, ETFs, bonds, and indices. You understand and agree that:

  • All trades are executed at your own risk and discretion
  • We do not provide investment advice, financial planning, or recommendations
  • Market prices are provided by third-party data providers and may experience delays
  • Trading involves substantial risk of loss (see Risk Disclosure)
  • Past performance does not guarantee future results
  • You are responsible for understanding the risks before trading

7. Deposits and Withdrawals

Deposits:

  • Deposits are credited after network confirmations and verification
  • We reserve the right to reject or return deposits from suspicious sources
  • Deposit methods and minimum amounts are subject to change

Withdrawals:

  • Withdrawal requests are processed within 1-3 business days (subject to verification)
  • Enhanced verification may be required for large withdrawals
  • We reserve the right to delay or deny withdrawals if fraud or suspicious activity is suspected
  • Network fees and processing fees may apply
  • You are responsible for providing accurate withdrawal addresses

8. Fees and Charges

SmartWealthForge charges fees for certain services:

  • Trading fees: Charged as a percentage of transaction value
  • Deposit fees: May apply depending on payment method
  • Withdrawal fees: Network fees plus processing fees
  • Inactivity fees: May be charged after prolonged account inactivity

Current fee schedules are available on our platform. We reserve the right to modify fees with reasonable notice.

9. Prohibited Activities

You may not use SmartWealthForge to:

  • Engage in market manipulation, wash trading, or fraudulent activity
  • Use the Platform for money laundering or terrorist financing
  • Create multiple accounts to circumvent restrictions
  • Use automated trading bots without authorization
  • Reverse engineer, decompile, or attempt to access our source code
  • Interfere with the Platform's operation or security
  • Violate any applicable laws, regulations, or third-party rights
  • Impersonate another person or entity

10. Staking Services

SmartWealthForge offers staking services for select cryptocurrencies. By participating in staking:

  • You understand that staked assets may be locked for a specified period
  • APY rates are estimates and not guaranteed
  • Rewards are distributed at our discretion and subject to network conditions
  • Unstaking may involve a waiting period
  • We may discontinue staking programs at any time

11. Intellectual Property

The Platform, including all content, features, and functionality, is owned by SmartWealthForge and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks, logos, or branding without authorization
  • Create derivative works based on our Platform

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • Market data will be accurate, complete, or timely
  • Defects will be corrected
  • The Platform is free of viruses or harmful components

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTWEALTHFORGE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Trading losses or investment losses
  • Damages resulting from unauthorized access to your account
  • Losses due to market volatility or price fluctuations

Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless SmartWealthForge, its affiliates, and personnel from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Your trading activity or investment decisions

15. Account Termination

We reserve the right to suspend or terminate your account:

  • For violations of these Terms
  • If we suspect fraudulent, illegal, or suspicious activity
  • If required by law or regulatory authorities
  • At our discretion with or without cause

Upon termination, you must immediately cease using the Platform. We will process legitimate withdrawal requests, subject to verification and applicable holds.

16. Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at legal@smartwealthforge.com to attempt informal resolution.

Arbitration: Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in San Francisco, California. You waive your right to a jury trial or class action lawsuit.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or platform notification. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
